Board of Assessment Appeals Minutes

Town of Enfield

 

DATE:  April 7, 2009

 

Board of Assessment Appeals special meeting was held in the Enfield Room, Town Hall.

 

The special meeting commenced at 4:00 p.m. with Rudolph Kuraska, Chairman, present; Charles Woods, member, present; Thomas Tyler, member, present.

 

Appeal for business personal property for Gold’s Gym at 640 Enfield St. (Audit)  Appeal #2, 3, and 4. Mr. Frank Rinaldi and Keith Brown, CPA present. 

 

           Mr. Rinaldi the owner of Gold’s Gym received a notice from the Assessor’s Office.  He thought it was a mistake.  He spoke to the assessor to see how the number was arrived at. Assessor stated compared to other Gold Gyms in Connecticut.  Mr. Rinaldi owns all the Gold Gyms in Connecticut and presented a comparison.

            Mr. Brown stated Golds is a black iron gym.  Golds can’t compare to other gyms.  Has less cardio equipment at his gyms.  Accountant presented the income tax return.

Mr. Brown stated the owners purchase equipment and keeps accumulating but doesn’t show the disposals.

            Mr. Tyler stated should be based on IRS returns.  Mr. Rinaldi stated equipment not removed from books.  All proper documents have been presented to Board.  He’s looking for only an increase for 2005 of 34,000; 2006 of 36,000; 2007 of 4,000.  All equipment would also have penalty.  See Tab 6 of presented document. 

            Mr. Rinaldi stated the auditing firm never stepped into the building.  Mr. Tyler questioned filing for 2008.  Mr. Rinaldi’s forms do not reflect 2008.  Mr. Rinaldi feels the assessor’s office should have guided him.  Mr. Rinaldi thought he appealed 2008 also.

 

Appeal for business personal property for Kim McBird,  Appeal #9.

 

            Ms. McBird registered a trade name in the Town Clerk’s office.  She does not own a business.  She registered the name only.  She does church business and is not compensated for her services.  She helps out at the youth center.  She has no personal property.

 

  Appeal for Donald Christmas, 25 Lincoln St.,  Appeal #1.

 

            Mr. Woods stated he does know Mr. Christmas. 

            Mr. Christmas stated his house has been on the market for nine months.  The price started at $165,000 and dropped to $125,000.  The best offer he has had is $89,000.  The house across the street sold for $135,000 and was gutted by the State.    House across the street sold for $140,000 and a house on Spring St. sold for $100,000. 

            Mr. Christmas stated his house needs a new roof, siding, windows.  He has water issues in the basement.  Has contacted the Town and the Town said there’s nothing they can do about it.  Mr. Christmas purchased the house from Siena/Nosal.  He stated the house is structurally sound, wiring has been upgraded but siding is gone on the left side of the house. 

            He appealed before.  Mr. Kuraska explained the value is as of 10/1/06.  Mr. Christmas stated his house was appraised back in 2006 for $104,000.  The town has a copy of his appraisal from when he appealed in 2006.  The Board asked the secretary to see if the assessor can locate the appraisal. 

 

Appeal for Roberta Bragan, 5 Harding Circle, Appeal #29

 

            Their assessment increased  $3,000.  They replaced a porch.  The old porch was bigger than the porch that replaced it.  Before it was a screened in porch on a slab and now it’s on piers.  The porch is now glass enclosed with no heat.  The wood deck is gone.  The Board asked the secretary to have the assessor verify.  The street card reflects two decks.

 

Appeal for Miroslaw Dyrkacz, 54 Booth Rd., Appeal #14

 

            Mr. Dyrkacz is looking for a temporary amendment.  He purchased the house in May 2008 for $80,000.  He paid cash.  There were no pipes, water was turned off.  The house was on the market for a long time.  It was sold “as is”.  He presented the Board with his building permits.  The Board requested Mr. Dyrkacz to drop off copies of permits. 

            The property was initially listed for $135,000 and was gradually dropped 10,000 at a time.  Right now the livable area is 800 sq. ft.

 

Appeal for David Flasinski, 9 Manning Rd. Appeal #5 

 

            Mr. Flasinski is appealing land problems that stem from the street.  The sidewalk in front of his house is underwater.  The catch basin does not accommodate the water.  A pipe travels through the yard.  The Town does not want to know anything about it. 

Mr. Flasinski would have to pull out his underground electricity and wiring for easement for the town to fix.  The sidewalk is lower than street.  Water goes down his driveway.  Site work was done by Hill Construction.

            At the beginning of Manning Rd. a carpet place and car wash were built and all water goes down the street into one catch basin.  He’s looking for reduction.  He has a driveway issue; sewage is being pumped into his yard.  His driveway is 230 feet long.  Costs about $30,000 to do a driveway.  Pictures presented to Board.

 

Appeal for Glen Bentz, C-5 Enfield Professional Center, Appeal #10

 

            Business condo located across the street from Stellas.  In 2004 he paid $35,000.  The town has a market value of $58,000.  He feels the fair market value should be $40,000.  Unit B recently sold for $185,000.  It has 2610 square feet at $70.80 a square.  Dr. Calnen’s was on the market for two years.  That unit sold for $79,900.  It has 1215 square feet at $65.65 a square.

            Mr. Bentz’s condo is 570 square feet.  At $70.80 a square his value would only be  $40,000.  The units are old, not selling, and have high maintenance fees.  Paperwork provided to Board.

 

Appeal for Glen Bentz, 5 Hemlock Dr. – withdrawn

           

Appeal for Richard Chmura, Business Personal Property, Appeal #43

 

            Mr. Tyler stated he went to school with Mr. Chmura.  He feels he has no conflict.  Mr. Chmura has no problem.  Exemption form went past the deadline.  He’s appealing losing the exemption.  He filed late.  Mr. Kuraska will review statutes regarding farm exemption.  Father passed away November 2007.

 

Appeal for Joseph Ingram Jr., Business Personal Property, Appeal #31

 

            He was laid off in July.  Executive Painting trade name filed.  Only has a ladder and paint brushes.  Doesn’t have a power washer or anything like that.

 

Appeal for Teresa Matuza, Business Personal Property, Appeal #46 - no show

 

The meeting adjourned at 6:35 p.m.
