Board of Assessment Appeals Minutes

Town of Enfield

DATE:  March 2, 2010

 

Board of Assessment Appeals special meeting was held in the Break Room, Town Hall

 

The special meeting commenced at 4:00 p.m. with Rudolph Kuraska, Chairman, present; Charles Woods, member, present; Thomas Tyler, member, present; Victoria Rose, secretary, present.

 

 

Appeal for Jesse Alfano, 15 Sherman Rd., Appeal #5

 

 

Appealed for house fire.  House has been condemned.  Fire took place on 5/23/09.  House was unlivable.  Permit pulled from building dept.   Insurance statement presented to the Board.  It is now close to 85% done.  House was brought down to studs.   $85,000 between land and structure per appraisal from mortgage company.  No documentation presented for appraisal.

 

 

Appeal for Hugh Lindo, 8 Keller Court, Appeal #6,  No Show

 

 

Appeal for Cecile Swols, Linda Phillips (agent), Business Personal Property, Appeal #7

 

 

Received penalty for filing late and did not receive farm exemption.  Mother receives the mail.  Mother was ill.  Mother thought due date was December 1, however, was due 11/2.  As soon as filed Ms. Phillips brought it in.  Mr. Kuraska stated will review statutes regarding filing.  Mr. Tyler asked if mom has dementia.  Ms. Phillips stated her mother is 82.

 

 

Appeal for Richard Houle, 36 Bailey Rd. Appeal #10

 

 

Vacant land next to his lot with a 55,160 assessment.  Slightly under one acre but is not exactly sure.  Real estate agent provided land values.  His is not developed land.  He has no sewers, etc.  There is no sewers on street at all.  One recently sold on his street but can’t remember.  His comparables are 215 State St., 1.22 acres with an assessment of 32,480; 201 State St. is 1.67 acres with an assessment of 38,200.  209 State St. has an assessment of 35,840 with 1.22 acres. Feels a fair market value of 32,000 – 35,000. 

Mr. Tyler questioned if there was any wetlands.  Mr. Houle stated no wetlands.

 

 

Appeal for Roger Christensen, 6 Madison Rd., Appeal #12

 

 

Appealing for messy appearance across the street, 5 Madison Rd.  It has been deteriorating since current owners purchased.  Presented pictures and copies of letters sent to Dan Vindigni.  Has lived there since 1966 and has never been to the Board.  The neighbors have lived there for ten years.  Would like him to clean up his yard.  There is also a problem with the pool.  Gate flies open in the wind and it is an inground pool. 

Mr. Woods suggested going to his councilman.  Mr. Houle stated next door received relief for blight from Board and lives on Hampton Rd.  Mr. Mgrdician was reduced by 3500.

 

 

Appeal for Sandra Labier, Business Personal Property, Appeal #15

 

 

License was for errand service but started to work for Caring Solutions a year ago.  Had made up fliers and posted at Mark Twain but did not receive any calls.  Her accountant said she didn’t have to file.  She has no assets.  Mr. Kuraska asked what her future plans were.  She would like to keep it going, thinks it’s a good idea.

 

 

Appeal for Stacey Forish, 20 Iroquois, Appeal #17

 

 

Stated she has no finished basement.  Purchased the home 19 months ago and previous owners used basement for dogs with hatchway open.  When she moved in ripped down ceiling.  Pictures presented to Board.  Mr. Kuraska requested secretary make appointment to inspect property with Assessor’s Office.

 

 

Mr. Thomas Tyler left the meeting at 5:40 p.m.

 

 

Appeal for ALG Properties, Andrew Harrison, 70  Tariff St., Appeal # 22

 

 

Requesting 10% penalty be waived from assessment.  Stated he didn’t receive form or misplaced it. When he received a later reminder did fill it out.  Historically was always on time.  He received a certified letter.  The letter did not state anything about penalty.  Has owned property for nine years and was never late.

 

 

The Board requested from secretary to obtain copy of certified letter and form sent.

 

 

Appeal for Stephen Nieroda, Business Personal Property, Appeal #28

 

 

Last August he received a full-time job.  He was a sub-contractor.  He has not been active since the fall.  He recently dissolved his business.  He had to file a trade name for the bank.  He only has brushes and rollers.  He didn’t fill out the form but only has paint brushes, rollers and scrapers.

 

 

Appeal for Paul Bellomo, 25 Enfield St., Appeal #33

 

 

Filed his income and expense form on the 29th of June.  It was due June 1st.  He later received a certified mailing that stated may waive penalty.  Showed a copy of letter from the Town Manager to Board.  The letter stated “could result in a penalty.”  Mr. Kuraska explained it is a one shot deal.  Next year will come off if filed on time. 

Mr. Bellomo also presented a copy of e-mail between him and the assessor.  Feels he should not have gotten a letter from Town Manager.  He filed but did file late. 

 

 

Appeal for Leon Kroczewski, Business Personal Property, Appeal #36

 

 

Asked what the notice of assessment increase was.  He did file with the assessor but  assessor’s office did not receive.  Does have a Sheetrock business.   He has no copy of what he filed.  Spoke to Pam in the assessor’s office.  Did not realize it was an assessment.  Thought it was a dollar amount.
