PUBLIC HEARING(S)
1. Call to Order: The meeting was called to order by Chairperson Gretchen Pfeifer-Hall at 7:02 p.m.
2. Pledge Of Allegiance: The Pledge of Allegiance was recited.
3. Roll Call: Present were: Chairperson Pfeifer-Hall and Agents Arnone, Kiner, Szewczak and Tallarita. Also present were Steven Sadlowski, Wetlands Agent and Susan Berube, Recording Secretary.
4. Hearing(s):
a. IW #479 Karios Properties, LLC – Permit to construct one new commercial building and add on to an existing commercial building with associated site improvements behind 151-155 Hazard Ave (Map 74 Lot 120), zoned BL. Submitted 3/6/07, Received 3/13/07, PPE 3/27/07, MPHCD 5/7/07, MPHAD 7/10/07: An extension to continue the public hearing to June 7, 2007 if necessary was granted by the applicant. A motion was made by Agent Szewczak and seconded by Agent Tallarita to continue IW #479 to the meeting of May 15, 2007 at 7:00 p.m. in the Town Hall. Vote was 5-0-0.
b. IW #481 Town of Enfield “Road 2005 Program”, excavating, paving, and drainage improvements within 100 feet of wetlands or watercourses. Section 5-A including Leary Rd., Bailey Rd., and Scitico St.. Section 5-B including Longview Rd., Stony brook Rd., Hillcrest Rd., and Star Ln.. Section 5-C including Westerly Dr., and Heron Rd. Sumbitted 3/13/07, Received 4/3/07, PPE 4/17/07. MPHCD 5/22/07, MPHAD 7/26/07 A motion was made by Agent Arnone and seconded by Agent Kiner to continue IW #481 to the meeting of May 15, 2007 at 7:00 p.m. in the Town Hall. Vote was 5-0-0.
c IW# 482 Town of Enfield – Road 2005, Section 1 – D’Annunzio Avenue. Road Reconstruction, including drainage improvements within 100’ of wetlands and watercourses. Submitted 3/27/07, Received 4/3/07, PPE 4/17/07 MPHCD 5/22/07, MPHAD 7/26/07: A motion was made by Agent Szewczak and seconded by Agent Tallarita to close the public hearing for IW #482. Vote was 5-0-0.
A motion was made by Agent Arnone and seconded by Agent Kiner to close the public hearing portion of the meeting at 9:57 p.m. Vote was 5-0-0.
REGULAR MEETING
1. Call to Order: The regular meeting was called to order by Chairperson Pfeifer-Hall at 9:58 p.m.
2. Roll Call: Present were: Chairperson Pfeifer-Hall and Agents Arnone, Kiner, Szewczak and Tallarita. Also present were Steven Sadlowski, Wetlands Agent and Susan Berube, Recording Secretary.
A motion was made by Agent Szewczak and seconded by Agent Arnone to change the order of business and move to Item #9, “Old Business, ‘e’ and Item #11, New Business, ‘a’.” Vote was 5-0-0.
e. IW # 486 Anthony Spazzarini / Little Sisters of the Poor. Construction of a new parking lot and associated drainage discharging into wetlands/watercourse. 1365 Enfield Street, Enfield, CT (Map 46- Lot 22) zoned HR-33. Submitted 4-16-07, Received 4/17/07, PPE 5/1/07, MAD 6/21/07: It was the consensus of the Agency members that a public hearing is not warranted for this application. A motion was made by Agent Szewczak and seconded by Agent Tallarita to approve IW #486 with the 10 standard conditions in addition to the following: 11. Double sumps to be utilized in the catch basins along with a hood for water quality management.
12. S/E controls to be installed and inspected per the recommendations of the Wetlands Agent.
13. With the exception of the additional items stated in these conditions, this application is approved in accordance with Site Plan entitled, “Site Plan, Saint Joseph’s Residence” prepared by Aeschliman Land Surveying, Inc. and dated 3-14-07. Any changes that would potentially cause greater impact to wetlands or watercourses, such as enlargement or re-orientation of structure footprints, from the plans and any denial or changes made by any other regulatory agency or commission shall require the permitee to come before the Enfield Inland Wetlands and Watercourses Agency for a Permit Modification or Determination of Permit Need (Jurisdictional Ruling).
Vote was 5-0-0. Reason for approval was that the applicant has demonstrated that the project will not adversely affect wetlands and watercourses.
11. New Business
- DPN 2007-04-17 Connecticut Water Company – Installation of a new pump house and associated utilities within 100’ of a wetland or watercourse. Spring Lot Property – 40 Booth Road (Map 59 - Lot 54), Zoned R-33: A motion was made by Agent Szewczak and seconded by Agent Kiner that a permit is not necessary for this application. Vote was 5-0-0.
A motion was made by Agent Szewczak and seconded by Agent Arnone to again change the order of business and move to “Old Business: ‘b’.” Vote was 5-0-0.
b. IW # 480 - Katherine & Robie Staples, Sr. Construction of a new commercial building and associated improvements within 100 feet of a wetland, 7 Anngina Drive (Map 82, lot 56), Zoned I-1. Submitted 3/9/07, Received 4/3/07, PPE 4/17/07 MAD 6/7/07: At 11:00 p.m. a motion was made by Agent Arnone and seconded by Agent Szewczak to extend the meeting until 11:30 p.m. if necessary. Vote was 5-0-0. A motion was made by Agent Szewczak and seconded by Agent Tallarita to approve IW #480 with the ten standard conditions in addition to the following 9 conditions as modified during discussion:
11. All engineering concerns are to be addressed prior to construction commencement.
12. On a monthly basis, the yard area must be inspected for debris (garbage, litter, etc) and removed to keep it from blowing into the wetlands.
13. Pesticides and fertilizers shall not be used on the property.
14. There shall be no lighting on the easterly side of the building.
15. From the proposed wetland plantings on the east side of the building toward the wetlands, no landscaping is to be installed. This area is to remain in its natural state. No leaves or other debris are to be removed or dumped in this area without first clearing the activity with the wetlands agent.
16. Wetlands agent to inspect silt fence / hay bales prior to issuance of building permit. Plans to show details of silt fence arrangement (to allow amphibian passage) as recommended by Mr. Logan.
17. “Cape-Cod” style curbing to be used to aid in amphibian access to the pool.
18. Those portions of the site where vernal pools exist, along with the land around them to the extent practical as approved by the agent, shall be placed under a conservation easement. This conservation easement area shall be first offered to the town. Conservation easement markers shall be installed in accordance with Town requirements, by a licensed surveyor, at the applicant's expense. Easement markers will be provided by the Planning Department. Where no trees are present greater than 6" dbh, easement markers shall be placed on 4"x4" wooden posts to demarcate the easement boundary. Should the Town Council decline the acceptance of the land area for open space, a notification shall be placed on the land records that indicates the extent of wetland resources on-site and the regulations governing those resources.
19. With the exception of the additional items stated in these conditions, this application is approved in accordance with Site Plan entitled "Site Development Plan, Property of Katherine and Robie Staples, Sr. 7 Anngina Drive Enfield, Ct"; sheets 1-5; dated 3-5-07, revised through 4-30-07; prepared by J. R. Russo & Associates. Any changes that would potentially cause greater impact to wetlands or watercourses, such as enlargement or re-orientation of structure footprints, from the plans and any denial or changes made by any other regulatory agency or commission shall require the permitee to come before the Enfield Inland Wetlands and Watercourses Agency for a Permit Modification or Determination of Permit Need (Jurisdictional Ruling).
