REGULAR MEETING

1. Call to Order The meeting was called to order by Chairperson Pfeifer-Hall at 7:01 p.m.

2. Roll Call: Present were: Chairperson Gretchen Pfeifer-Hall and Agents Arnone, Kiner, LeMay, Staples and Szewczak. Also present were Steven Sadlowski, Wetlands Agent and Susan Berube, Recording Secretary.

Agent LeMay was empowered as a full voting member by Chairperson Pfeifer-Hall.

3. Executive Session

Matters regarding specific employees, pending litigation, acquisition of real estate and / or matters exempt from disclosure requirements. There were no items for discussion in executive session.

4. Public Participation - Issues of concern not on the agenda. No one in the audience came forward to speak.

5. Correspondence: Three items of correspondence were received.

6. Commissioner’s Correspondence: One item regarding pesticide and herbicide standards was discussed.

7. Approval of Minutes – June 5, 2007: A motion was made by Agent Szewczak and seconded by Agent LeMay to approve the minutes of the meeting of June 5, 2007 with the following amendments: 4th page, 8th paragraph, delete “area of disturbance is”, insert: “site is”; page 7, 4th paragraph, remove “thin”, replace with “then”. Vote was 3-0-3(Kiner, Arnone, Staples).

8. Wetlands Agent Report – June 5, 2007 – June 19, 2007

9. Old Business

a. IW #479 Karios Properties, LLC – Permit to construct one new commercial building and add on to an existing commercial building with associated site improvements behind 151-155 Hazard Ave (Map 74 Lot 120), zoned BL. Submitted 3/6/07, Received 3/13/07, PPE 3/27/07, MPHCD 6/7/07, MPHAD 8/12/07. (MPHCD Extended – 31 of 65 extension days used): A motion was made by Agent Arnone and seconded by Agent Staples to approve IW#479 with the 10 standard conditions in addition to the following #11-28: 11. Parking lot and surrounding areas, especially near dumpsters and break areas, in both the new and existing buildings, to be inspected weekly for garbage, debris and other pollutants. If any are found they shall be removed immediately. Inspection/Maintenance schedule on plans must also be followed.

12. Wetlands and surrounding areas, which are to be left in their natural state (including temporarily disturbed areas such as the pipe crossing and the detention pond) and any mitigated areas will be posted with signs reading “Sensitive Wetland Area No Dumping or Disturbing” or similar wording as approved by the Wetland Agent. Signs shall be placed around the perimeter of the wetland area at intervals not to exceed 50 feet.

13. All sediment and erosion controls must be in place and approved by the Wetlands Agent prior to signing off on the building permit.

14. A performance surety bond shall be posted for created wetlands, all detention basins, and infiltration basins/rain gardens and enhancement plantings. The bond, in the appropriate form, shall be posted for 125% of the cost estimated by the applicant for creation, restoration, enhancement and monitoring as proposed in the approved plans and outlined in the report dated March 9, 2007 by Michael F. Gragnolati. The bond amount is to be set by the Wetlands Agent and the full amount posted prior to issuance of any building permits. The bond shall be held for a period of no less than three years. The bond shall be release by a vote of the IWWA upon an inspection & final monitoring report by the Environmental Professional and determination that the work was completed as approved and completed to the Agency’s satisfaction.

15. The Wetlands Mitigation Area work shall be performed under the supervision of an environmental professional. It shall be inspected and accepted by both the Wetlands Agent and the applicant’s Environmental Professional. The Environmental Professional will certify in writing that the work was done according to the approved plan, including excavation elevations, structures, soil composition and plantings. After completion, the Environmental Engineer shall monitor the site for a period of three years to ensure its success. Any work needed to ensure the success of the plan (including but not limited to replanting, re-grading, repairing eroded areas etc.) as recommended by the Environmental Professional shall be completed by the applicant. Inspections may also be made by the Wetlands Agent or other representatives of the Agency and any issues noted by them shall be addressed to the Environmental Professional for his review.

16. The site contractor shall certify to the Wetland Scientist and Wetlands Agent that any fill material or top dressing brought on site is free of seeds and fragments/plants of invasive species.

17. Common Reed (a.k.a. phragmites) shall be removed from the detention pond and/or the Mitigation Areas. The permittee shall remove the Common Reed using only the methods approved/recommended by the Department of Environmental Protection and/or the Connecticut Agricultural Experimental Station. The procedure involves cutting the stalks in late August, early September and applying herbicide directly into the open end of the stalk. An individual licensed in such application shall apply the herbicide. In order to successfully eliminate this vegetation the process may need to be repeated in sequential years. This work shall be included in the scope of work under the bond listed in condition #14.

18. All existing trash and debris on site is to be removed and properly disposed of prior to the Wetlands Agent signing off on the building permit.

19. Areas around the detention ponds/rain gardens shall be planted with the same wetlands planting schedule listed on the plans (including Highbush Blueberry, Silky Dogwood and Northern Arrowwood varieties) plus an appropriate number of trees as approved by the Wetlands Agent in addition to the wetlands seed mix as indicated on the plans. This information shall be included in the final set of plans.

20. The last catch basins in the “train” and those feeding any underground infiltration units shall be fitted with hoods and double-deep sumps.

21. Infiltrator units, where practical as per review by applicant’s Engineer and the Town Engineer shall be installed as approved by the Town Engineer.

22. Parking stops, fence or similar measures shall be installed in areas without curbs to keep automotive traffic from entering the wetland areas.

23. The applicant shall employ slow release fertilizers and minimal applications of pesticides and herbicides, as prescribed by best management practices (BMPs), in establishing landscaping throughout the site. The management plan prepared for this development shall indicate that slow release fertilizers and minimal applications of pesticides and herbicides, as prescribed by BMPs shall be employed in the maintenance of this property. A copy must be provided to the Enfield Department of Planning before the Wetlands Agent may sign off on the building permit.

24. All aspects of the stormwater system for the building being built, including rain gardens, and the expanded detention area, must be constructed at the same time as the rough grading of the parking lot and building site and stabilized before the foundations are poured.

25. All snow stockpile areas are to be posted as snow stockpile areas. Snow in excess of what fits in these areas must be removed from the site.

26. Curb to be added along south side of lot near wetland flags 5-10 and the pavement graded, to force stormwater into the rain garden area.

27. All areas of disturbance within 30 feet of wetlands to have a double silt fence installed, 3 feet apart.
28. With the exception of the additional items stated in these conditions, this application is approved in accordance with the Site Plan entitled “Karios, LLC Office/Retail Development. 151-155 Hazard Avenue Rear, Enfield, CT”; sheets 1-4; dated 10/2/06 and revised to 5/25/07; prepared by Gary B. LeClair, LLC., 36 Suffield Street, Windsor Locks, CT 06096. Any changes that would potentially cause greater impacts to wetlands or watercourses, such as enlargement or reorientation of structure footprints, from the plans and any denial or changes made by any other regulatory agency or commission shall require the permitee to come before the Enfield Inland Wetlands and Watercourses Agency for a Permit of Modification or Determination of Permit Need (Jurisdictional Ruling).

Vote was 2(Arnone, Staples)-1(Pfeifer-Hall)-3(LeMay, Szewczak, Kiner). Reason for approval was that the project, with mitigation, will not adversely affect wetlands and watercourses.

a. IW-488 Neal and Susan Peterson – Installation of a driveway and footing drain within the upland review area. 114 North Street (Map 100, lot 4) Zoned I-1. Submitted 5/15/07, Received 6/5/07, PPE 6/19/07, MAD 8/9/07: A motion was made by Agent Szewczak and seconded by Agent Arnone to approve IW# 488 with the 10 standard conditions, in addition to the following #11 - 15: 11. Erosion and sediment controls must be installed prior to the Wetlands Agent signing off on the building permit;
12. The Wetlands Agent will not sign off on the certificate of occupancy until all disturbed areas, including roof and footing drain outlets, are temporarily and/or permanently stabilized or a stabilization bond is posted if the certificate of occupancy is requested outside of the planting season;

13. A note shall be placed on the plot plan and deed before the wetland agent shall sign off on the building permit for each lot stating: “Portions of this lot contain wetlands and/or watercourses and are therefore subject to the Enfield Inland Wetlands and Watercourses Regulations as amended. No disposing of leaves, grass clippings, brush or other lawn refuse, grading, filling or other modification shall be made to the portion of this lot that is within 25 feet of wetlands".

14. Footing drain to be positioned as to create the least disturbance possible to any mature growth near the wetlands.
15. With the exception of the additional items stated in these conditions, this application is approved in accordance with the site plans entitled "Site Plan, Peterson Family Residence Assessor’s Lot R75 114 North Street Enfield, CT"; dated July 2006 revised through 1-16-07; 2 sheets; prepared by Prepared by R.R. Hiltbrand Engineers and Surveyors 21 Copper Hill Road Granby, CT.. Any changes that would potentially cause greater impact to wetlands or watercourses, such as enlargement or reorientation of structure footprints from the plans and any denial or changes made by any other regulatory agency or commission shall require the permittee to come before the Enfield Inland Wetlands and Watercourses Agency for a Determination of Permit Need (Jurisdictional Ruling) or request for modification. Vote was 6-0-0. Reason for approval is that the applicant has demonstrated that the project will not adversely affect wetlands and watercourses.

b. IW-491 J&L Builders LLC – Review of site specific development plans in previously approved subdivision. Lot 4 – 96 Post Office Road. Submitted 6-1-07, Received 6/5/07, PPE 6/19/07, MAD 8/9/07: A motion was made by Agent Arnone and seconded by Agent LeMay to table discussion on IW#491 to the meeting of July 10, 2007 at 7:00 p.m. in the Council Chambers. Vote was 6-0-0.

c. IW-492 J&L Builders LLC – Review of site specific development plans in previously approved subdivision. Lot 5 – 98 Post Office Road . Submitted 6-1-07, Received 6/5/07, PPE 6/19/07, MAD 8/9/07 A motion was made by Agent Arnone and seconded by Agent Kiner to table discussion on IW#491 to the meeting of July 10, 2007 at 7:00 p.m. in the Council Chambers. Vote was 6-0-0.

A motion was made by Agent Arnone and seconded by Agent LeMay to add the following to the New Business portion of the agenda after #494: “Brendan M. Begley, Construct 2,800 square foot business/professional office building and associated parking, 35 Oliver Road”. Vote was 6-0-0.

10. New Business

a. IW 493 – Hallmark Cards – Expansion of parking lot within 100 feet of a wetland or watercourse - 25 Bacon Road (Map 95 Lot 5) zoned I-1 submitted 6/6/07, Received 6/19/07, PPE 7/3/07, MAD 8/14/07: It was the consensus of the Agency members that a public hearing is not necessary for this application. A motion was made by Agent Arnone and seconded by Agent Staples to table IW#493 to the meeting of July 10, 2007 at 7:00 p.m. in the Council Chambers. Vote was 6-0-0.

b. IW 494 – Barbara Barberie – Landscaping within 100’ of wetlands – 6 Dorothy Street (Map 57 lot 154) zoned R-33. Submitted 6/13/07, Received 6/19/07, PPE 7/3/07, MAD 8/14/07: It was the consensus of the Agency members that a public hearing is not necessary for this application. A motion was made by Agent Arnone and seconded by Agent Staples to table IW#494 to the meeting of July 10, 2007 at 7:00 p.m. in the Council Chambers. Vote was 6-0-0.

c. IW 495 – Brendan Begley, Construct 2,800 square foot business/professional office building and associated parking, 35 Oliver Road”. Vote was 6-0-0: It was the consensus of the Agency members that a public hearing is not necessary for this application. A motion was made by Agent Staples and seconded by Agent Arnone to table IW#495 to the meeting of July 10, 2007 at 7:00 p.m. in the Council Chambers. Vote was 6-0-0.

c. DPN 06-13-07 Town of Enfield – Steven Sadlowski, Planning – Request for exemption as allowed under section 4.1.a (gardening) for a proposed community garden (in grant stage) on Town land at Main and Pearl Streets along the banks of the Freshwater Brook in Thompsonville: A motion was made by Agent Arnone and seconded by Agent Kiner that a permit is not necessary for this application. Vote was 6-0-0.

11. New Applications to be accepted

As presented by the Agent to the Agency at the meeting, if applicable.

12. Other Business

a. Letter of Violation – Mark J. Desrosiers – clearing, grubbing, filling on the bank of the Scantic River. 12 Leary Road: After discussion, it was the consensus of the Agency members to direct Mr. Sadlowski to discuss the Agency’s concerns with Mr. Desrosiers.

Next regular meeting is Tuesday, July 10, 2007 at 7:00PM in the Council Chamber.

13. Adjourn: A motion was made by Agent Staples and seconded by Agent Arnone to adjourn the meeting at 10:47 p.m. Vote was 6-0-0.
