PUBLIC HEARING(S)

1. Call to Order: The public hearing was called to order by Chairperson Gretchen Pfeifer-Hall at 7:37 p.m.

2. Pledge of Allegiance: The Pledge of Allegiance was not recited. An American Flag was not in the meeting room.

3. Roll Call: Present were: Chairperson Pfeifer-Hall and Agents Arnone, Camidge, Kiner, and Wawer. Also present were Steven Sadlowski, Wetlands Agent and Susan Berube, Recording Secretary.

4. Hearing(s):

IW-460-02 Somerset Development Corporation - modifications to existing permit for Stonegate Senior Residential Development. East end of Mayfield Drive, North of Westview Drive and Northwest of Shaker Pines Lake (Map 79 - Lots 11,12,13 & Map 96 - Lot 11) Zoned R-44. Submitted July 5, 2007, Received July 10, 2007, PPE July 24, 2007, MPHCD October 9, 2007: A motion was made at 9:16 p.m. by Agent Wawer and seconded by Agent Kiner to continue the public hearing to the next regular IWWA meeting on September 18, 2007 at 7:00 p.m. in the Council Chambers. Vote was 5-0-0.

A motion was made by Agent Arnone and seconded by Agent Wawer to close the public hearing portion of the meeting at 9:17 p.m. Vote was 5-0-0.

REGULAR MEETING

1. Call to Order: The regular meeting was called to order by Chairperson Gretchen Pfeifer-Hall at 9:19 p.m.

2. Roll Call: Present were: Chairperson Pfeifer-Hall and Agents Arnone, Camidge, Kiner, and Wawer. Also present were Steven Sadlowski, Wetlands Agent and Susan Berube, Recording Secretary.

3. Executive Session

Matters regarding specific employees, pending litigation, acquisition of real estate and / or matters exempt from disclosure requirements. There were no items for discussion in Executive Session.

4. Public Participation - Issues of concern not on the agenda: No one in the audience came forward to speak.

5. Correspondence: Nine items of correspondence were received.

6. Commissioner's Correspondence: Two items were noted.

7. Approval of Minutes -July 24, 2007: A motion was made by Agent Arnone and seconded by Agent Camidge to approve the minutes of the meeting of July 24, 2007 with the following amendments: page 4, 4th paragraph, 2nd sentence, delete “to be”, insert “shall”; page 5, 2nd paragraph, second sentence, add “saw” after “Pfeifer-Hall”; 7th paragraph, add “A” to “Gent”; page 9, 1st paragraph, 2nd line, remove “gravels”, insert “travels”; 4th paragraph, 1st sentence, remove “to”. Vote was 3-0-2(Kiner & Wawer).

9. Old Business

a. IW-460-02 Somerset Development Corporation - modifications to existing permit for Stonegate Senior Residential Development. East end of Mayfield Drive, North of Westview Drive and Northwest of Shaker Pines Lake (Map 79 - Lots 11,12,13 & Map 96 - Lot 11) Zoned R-44. Submitted July 5, 2007, Received July 10, 2007, PPE July 24, 2007, MPHCD October 9, 2007: A motion was made by Agent Arnone and seconded by Agent Wawer to table discussion on IW – 460-02 until the meeting of September 18, 2007 at 7:00 p.m. in the Council Chambers. Vote was 5-0-0.

b. IW-499 Powder Hill Sand and Gravel LLC - 23 Unit Senior Residential Development. Upgrade of existing Town drainage culvert and outflow in a regulated area on CT Water Company Property (across street). Powder Hill Road, map 84, lot 15 (development) and lot 16 (drainage improvement) - zoned R-88. Submitted July 16, 2007, Received July 24, 2007, PPE August 7, 2007, MAD Sept. 27, 2007. (request to withdraw received). The Agency received a written request to withdraw this application. A petition to hold a public hearing was received within the 7 day petition period.

10. New Business

a. IW-493-02 Hallmark Cards - Modification of permit condition # 12 to allow spraying of entire plant with herbicide, rather than placing in stalks and, adjusting the prescribed time frame for this procedure. 25 Bacon Road (map 95, lot 005) zoned I-1 Submitted August 15, 2007, Received September 4, 2007, PPE September 18, 2007, MAD November 3, 2007: A motion was made by Agent Wawer and seconded by Agent Arnone to table further discussion on IW-493-02 until the meeting of September 18, 2007 at 7:00 p.m. in the Council Chambers. Vote was 5-0-0.

b. IW-500 Top-Knot, LLC - Construction of a new distribution facility and related site improvements. 479 Taylor Road (Map 100, Lot 11) zoned I-1. Submitted August 21, 2007, September 4, 2007, PPE September 18, 2007, MAD November 3, 2007: After a consensus that a public hearing for this application is not necessary, a motion was made by Agent Wawer and seconded by Agent Camidge to table further discussion on this application until the meeting of September 18, 2007 at 7:00 p.m. in the Council Chambers. Vote was 5-0-0.

c. IW-501 Powder Hill Sand and Gravel LLC - 23 Unit Senior Residential Development. Upgrade of existing Town drainage culvert and outflow in a regulated area on CT Water Company Property (across street). Powder Hill Road, map 84, lot 15 (development) and lot 16 (drainage improvement) - zoned R-88. Submitted August 29, 2007, Received September 4, 2007, PPE September 18, 2007, MAD November 8, 2007: Chairperson Pfeifer-Hall recused herself from this application due to a potential conflict of interest. She also stated that she may change her position of recusal at future discussions of this application. Agent Arnone acted as chairperson for this application. A motion was made by Agent Wawer and seconded by Agent Camidge to waive the application fee for IW-501. Vote was 4-0-0.

At 10:42 p.m., a motion was made by Agent Wawer and seconded by Agent Camidge to briefly table further discussion on this application to no later than 10:55 p.m. so that the applicant’s representative could confer with the applicant by telephone. Vote was 4-0-0.

Chairperson Pfeifer-Hall returned to the meeting at this time.

d. IW-386-02 Town of Enfield (JFK School) - Slope stabilization project. 155 Raffia Road. Request a change of condition #12 to allow work to continue beyond the specified stop date. Submitted August 30, 2007, Received September 4, 2007, PPE September 18, 2007, MAD November 8, 2007: A motion was made by Agent Arnone and seconded by Agent Wawer to table discussion on IW 386.02 to the meeting of September 18, 2007 at 7:00 p.m. in the Council Chambers. Vote was 5-0-0.

At this time, Chairperson Pfeifer-Hall again recused herself while the Agency returned to IW 501. Agent Arnone acted as chairperson for this application. A motion was made by Agent Wawer and seconded by Agent Kiner to table any further discussion this evening and to schedule a public hearing on IW 501 for the meeting of September 18, 2007 at 7:00 p.m. in the Council Chambers. Vote was 4-0-0.

Chairperson Pfeifer-Hall returned to the meeting at this time.

e. IW#453-03 - Town of Enfield - Modification of Existing Permit to restore and stabilize stream bed. Request change to condition # 17 to allow work to continue beyond the specified stop date. Activity located on properties North of Yale Drive and East of Hillyer Drive and between Yale Drive and Broad Leaf Lanes. Map 19, Lots 153-156, 199-201, and 210-211. Submitted August 30, 2007, Received September 4, 2007, PPE September 18, 2007, MAD November 8, 2007: A motion was made by Agent Wawer and seconded by Agent Arnone to table further discussion on IW 453-03 to the meeting of September 18, 2007 at 7:00 p.m. in the Council Chambers. Vote was 5-0-0.

11. New Applications to be accepted: None

As presented by the Agent to the Agency at the meeting, if applicable.

12. Other Business: None

Next regular meeting is Tuesday, September 18th at 7:30PM in the Council Chamber.

13. Adjourn: A motion was made by Agent Wawer and seconded by Agent Arnone to adjourn the meeting at 11:02 p.m. Vote was 5-0-0.
