1. Call to Order: The meeting was called to order at 7:00 p.m.
2. Pledge of Allegiance: The Pledge of Allegiance was recited.
3. Roll Call: Present were: Chairperson Gretchen Pfeifer-Hall and Agents Arnone, Camidge, Kiner and Lemay. Also present were Steven Sadlowski, Wetlands Agent, and Susan Berube, Recording Secretary.
4. Hearing(s):
IW-460-02 Somerset Development Corporation – modifications to existing permit for Stonegate Senior Residential Development. East end of Mayfield Drive, North of Westview Drive and Northwest of Shaker Pines Lake (Map 79 – Lots 11,12,13 & Map 96 – Lot 11) Zoned R-44. Submitted July 5, 2007, Received July 10, 2007, PPE July 24, 2007, MPHCD October 9, 2007. A motion was made at 9:13 p.m. by Agent Kiner and seconded by Agent Arnone to continue the public hearing for IW-460-02 to the meeting of October 2, 2007 at 7:00 p.m. in the Council Chambers. Vote was 5-0-0.
IW-501 Powder Hill Sand and Gravel LLC – 23 Unit Senior Residential Development. Upgrade of existing Town drainage culvert and outflow in a regulated area on CT Water Company Property (across street). Powder Hill Road, map 84, lot 15 (development) and lot 16 (drainage improvement) - zoned R-88. Submitted August 29, 2007, Received September 4, 2007, PPE September 18, 2007, MAD November 8, 2007. Due to a potential appearance of a conflict of interest, Chairperson Pfeifer-Hall recused herself from this application. Agent Arnone, Vice Chair, opened the public hearing. Mr. Sadlowski reported that he received a letter from the applicant requesting that the public hearing be postponed to the next meeting. At 9:17 p.m., a motion was made by Agent Kiner and seconded by Agent Lemay to continue the public hearing to the meeting of October 2, 2007 at 7:00 p.m. in the Council Chambers. Vote was 4-0-0.
At this time, a brief recess was held.
REGULAR MEETING
1. Call to Order: The regular meeting was called to order at 9:28 p.m. by Chairperson Gretchen Pfeifer-Hall.
2. Roll Call: Present were: Chairperson Gretchen Pfeifer-Hall and Agents Arnone, Camidge, Kiner and Lemay. Also present were Steven Sadlowski, Wetlands Agent, and Susan Berube, Recording Secretary.
3. Executive Session
Matters regarding specific employees, pending litigation, acquisition of real estate and / or matters exempt from disclosure requirements. There were no items for discussion in executive session.
4. Public Participation - Issues of concern not on the agenda: No one in the audience came forward to speak.
A motion was made by Agent Arnone and seconded by Agent Lemay to move to the Old Business portion of the agenda, beginning with IW 493-02. Vote was 5-0-0.

a. IW-493-02 Hallmark Cards – Modification of permit condition # 12 to allow spraying of entire plant with herbicide, rather than placing in stalks and, adjusting the prescribed time frame for this procedure. 25 Bacon Road (map 95, lot 005) zoned I-1 Submitted August 15, 2007, Received September 4, 2007, PPE September 18, 2007, MAD November 3, 2007: A motion was made by Agent Arnone and seconded by Agent Lemay to approve IW-493-02 with the 10 standard conditions, as well as the conditions of IW-493, with condition #12 being amended to read: “Common Reed (a.k.a. Phragmites) shall be removed from areas adjacent to the new parking lot drainage swales. The permitee shall remove the Common Reed only using methods approved / recommended by the Department of Environmental Protection and / or the Connecticut Agricultural Experimental Station. The procedure involves either cutting the stalks and applying herbicide directly into the open end of the stalk or, for larger stands, using a broadcast sprayer and spraying the entire plant, during the period of late August through the first frost. An individual licensed in such application shall apply the herbicide. In order to successfully eliminate this vegetation, the process may need to be repeated in sequential years.”
Vote was 5-0-0. Reason for approval was that the Applicant has demonstrated that the project will not adversely affect wetlands and watercourses.
b. IW-500 Top-Knot, LLC - Construction of a new distribution facility and related site improvements. 479 Taylor Road (Map 100, Lot 11) zoned I-1. Submitted August 21, 2007, September 4, 2007, PPE September 18, 2007, MAD November 3, 2007: A motion was made by Agent Kiner and seconded by Agent Arnone to approve IW-500 with the 10 standard conditions, in addition to the following, 11 through 18: 11. Plants indicated around the extended detention basin shall consist of wetlands shrubs such as Silky or Red-Ossier Dogwoods, Highbush Blueberry or Northern Arrowood (focus on using plants that are thriving in the area currently, if applicable). The placement of these plants will be at the discretion of the wetlands agent.
12. The area disturbed by the installation of the outlet shall be re-vegetated with a wetland seed mix and an assortment of the bushes listed in #11. These are to be planted in a pattern consisting of three bushes clumped together, placed five feet on center, throughout the disturbed area.
13. Conservation seed mix (CSM) may be substituted in the western swale as it will not likely become a wetland.
14. Drainage swale for the field water (eastern-most swale) shall be installed at the time of the extended detention basin (first in construction sequence, after E/S controls) and shall utilize a Erosion control mat in its base to protect the soils while the swale vegetates.
15. Drainage swale for the parking lot and roof shall be installed as early in the process as possible to allow the vegetation to mature before directing the flows from their sources into them. If they are not vegetated by the time the flows are introduced, a mat is to be used as in #14.
16. This approval does not include the proposed addition to the east of the currently proposed building. At the time this addition is constructed, the applicant will need to apply for a new permit for this activity.
17. All engineering concerns and comments must be addressed prior to commencement of construction activities.
18. With the exception of the additional items stated in these conditions, this application is approved in accordance with Site Plan entitled "New Facility, Moody Road, Enfield, CT – Applicant Jeff Mitchell, Top Knot, LLC"; sheets C 1-5; dated 8/20/07, revised through 9/18/07; prepared by Sage Engineering, Westfield, MA. Any changes that would potentially cause greater impact to wetlands or watercourses, such as enlargement or re-orientation of structure footprints, from the plans and any denial or changes made by any other regulatory agency or commission shall require the permitee to come before the Enfield Inland Wetlands and Watercourses Agency for a Permit Modification or Determination of Permit Need (Jurisdictional Ruling). Vote was 5-0-0. Reason for approval was that the project, with mitigation, will not adversely affect wetlands and watercourses.
c. IW-501 Powder Hill Sand and Gravel LLC – 23 Unit Senior Residential Development. Upgrade of existing Town drainage culvert and outflow in a regulated area on CT Water Company Property (across street). Powder Hill Road, map 84, lot 15 (development) and lot 16 (drainage improvement) - zoned R-88. Submitted August 29, 2007, Received September 4, 2007, PPE September 18, 2007, MAD November 8, 2007: A motion was made by Agent Arnone, seconded by Agent Lemay to table discussion on this application to the meeting of October 2, 2007 at 7:00 p.m. in the council chambers. Vote was 4-0-0(Chairperson Pfeifer-Hall).
b IW-386-02 Town of Enfield (JFK School) – Slope stabilization project. 155 Raffia Road. Request a change of condition #12 to allow work to continue beyond the specified stop date. Submitted August 30, 2007, Received September 4, 2007, PPE September 18, 2007, MAD November 8, 2007: A motion was made by Agent Arnone and seconded by Agent Camidge to eliminate the original condition #12 of IW-386 and replace it with the following: #12: Staff will watch the weather closely. In the event of a significant rain event, the wetlands agent has the ability to stop the project and order stabilization of the project. Vote was 5-0-0.
e. IW#453-03 – Town of Enfield – Modification of Existing Permit to restore and stabilize stream bed. Request change to condition # 17 to allow work to continue beyond the specified stop date. Activity located on properties North of Yale Drive and East of Hillyer Drive and between Yale Drive and Broad Leaf Lanes. Map 19, Lots 153-156, 199-201, and 210-211. Submitted August 30, 2007, Received September 4, 2007, PPE September 18, 2007, MAD November 8, 2007:
A motion was made at 10:58 p.m. by Agent Arnone to extend the meeting up to 30 minutes. Seconded by Agent Lemay. Vote was 5-0-0.
A motion was made by Agent Arnone and seconded by Agent Kiner to change condition Condition #17 to apply to the area between Broadleaf Lane and Meadowlark Drive to allow work to continue beyond the specified stop date of September 30 (for the Broadleaf to Yale section) and only in low flow periods. Work in this area will cease and the area stabilized prior to a significant rain event. The remainder of the work area will be completed only during times specified in the original conditions of approval.
Vote was 5-0-0. Reason for approval was that the applicant has demonstrated that the project will not adversely affect wetlands and watercourses.
