MINUTES OF A REGULAR MEETING

JULY 26, 2006

A Regular Meeting of the Enfield Historic District Commission was held on Wednesday, July 26, 2006 in the Enfield Room, lower level, 820 Enfield Street, Enfield, Connecticut. Chairman Richard Tatoian called the meeting to order at 7:00 p.m.

Chairman Tatoian welcomed Marie Troiano, a new member, to the Commission.

HDC#322Charles and Dawne Young, 1293 Enfield Street, Installation of a Clear Water gutter protection system. EHDO Section 8.

Dawne Young stated she is the owner of 1293 Enfield Street and has owned it since September, 2004. She noted when doing some recent roof work, they found that the gutters had been destroyed. They would like to install a maintenance free gutter system in order to eliminate a lot of maintenance.

Ms. Young stated Clear Water gutters are gutters that have a cap on them to make them maintenance free. A picture of this system was submitted to the Commission.

Ms. Young stated the gutters will be installed on the front of the house and a cap will be installed on the existing gutters. The front of the house has nothing but other areas still have the old gutters and are salvageable.

Regarding any change to the appearance, Ms. Young stated the gutters will look the same as what exists. The plan includes reinstalling a gutter on the front of the house.

Chairman Tatoian asked if there will be new gutters installed around the rest of the house. Ms. Young stated about fifty percent of the area will have new gutters with caps. The areas along the porch and on the other side have gutters that are salvageable. The front of the home will have new white downspouts which will replace what was there.

Mr. Gwozdz asked about the material for the gutters that were in the front. Ms. Young stated they were aluminum. They plan to replace with aluminum.

Mr. Meyer asked if the shape of the gutter that will be added to the front is the same as the shape of the gutter that was removed. Ms. Young stated yes and the only difference is there will be caps on them now.

Mr. Meyer asked if he was driving down Enfield Street, how far back from the road is this house located. Ms. Young estimated about 300’. Mr. Alsbaugh clarified that it is approximately 220’.

Mr. Meyer asked if he was traveling north or south on Route 5, would the addition of the shields be noticeable from the street. Joseph Young stated the shield will be the same color as the shingles and it will look just like the roof. There would be no change to the appearance of the front of the house.

Ms. Dean asked if a photo of this home is available. Mr. Alsbaugh stated he does not have one at this time.

Mr. Alsbaugh stated this property has been listed as having two street addresses. Previously, it may have been used as a two-family home since the mailing address is different from the listing of the house on the assessor’s records.

Mr. Meyer asked if this is the old Tal Young house. Ms. Young stated it is the Ephraim Terry house. She added it used to be used as a rectory for the church.

Marie Troiano asked if the gutters will be in the same location as the old ones and Ms. Young confirmed that to be the case.

Chairman Tatoian opened this hearing to the audience. No one spoke in favor or against this application. Chairman Tatoian closed this public hearing.

Mr. Gwozdz made a motion, seconded by Ms. Smyth, to approve the request for a Certificate of Appropriateness to install a ‘Clear Water’ gutter system on the main house, 1293 Enfield Street.

Such product to be installed, and the areas and manner in which it will be installed or used, shall be as described and as discussed in the public hearing under HDC #322, and as shown on any site plans, in any product sheets or sight photographs, and per any samples as displayed during the above mentioned public hearing.

Chairman Tatoian felt the proposal is consistent with the design of the house and does not produce any significant change to its physical appearance.

The motion was approved by a 5 – 0 – 0 vote with Alternate Troiano voting.

The reason for approval is the proposal is not inconsistent with the design of the house and it will not be a major visual change to the appearance of the house.

HDC – Review files, determinations of need for certificates of appropriateness

Mr. Alsbaugh informed the Commission of the action he took regarding HDCR2006-008, Joseph Santanella, 1121 Enfield Street. This was a request for re-roofing with an upgrade of material and design using architectural shingles. The related paperwork was submitted to the Commission for information purposes.

Mr. Alsbaugh brought up HDCR2006-009, Marie Troiano. This was done as an administrative approval based on the minimal nature of the fence installation that met the criteria the Commission has been setting for fence replacement. The drawing shows an empty spot on the north side property line between Ms. Troiano’s property and her neighbor. She has a line of arborvitae that come out from the northwest corner along that north line approximately 50’ and then there’s a 48’ empty spot. On the north side of that is the neighbor’s activity area causing a privacy issue. The fence would go from the end of the arborvitae line up to about even with the corner of the house. The information also shows that the fence is a cedar fence from Cape Cod Fence Company and it is scalloped or curved in between the posts. The fence construction will be tongue and groove. Mr. Alsbaugh also stated the proposed fence will have each of the posts capped with the shallow profile pyramid cap.

Mr. Meyer stated this has already been approved but he asked if the neighbors have been contacted. Ms. Troiano stated the neighbors have not been contacted since they are new and they are renters. Ms. Troiano stated she purchased this property in January, 2005. Mr. Meyer had a concern that there is no opportunity to see if there are any objections from the owner or occupants of the adjacent house. Mr. Alsbaugh noted there is no requirement for a zoning permit for fences.

Mr. Meyer stated if this was a new application, the standard procedure would be that there would be an opportunity for people to voice their objections. With this administrative approval, that option is not available. He suggested in the future that the applicant contact the neighbors. Mr. Alsbaugh stated if it doesn’t require a public hearing, then it doesn’t require the comment from the abutter. Fences all over town do not require a permit. They do not require approval by neighbors. The Planning Office does recommend that fences are placed a foot or so in from the property line so that maintenance can be performed.

Mr. Alsbaugh suggested that when an administrative approval is performed that he or the person bringing the question to him about the proposal should submit some sort of comment from the affected neighbor.

STAFF REPORT

Mr. Alsbaugh noted Commission members have received an updated membership list. There are also copies of the certificates that went out from last month and Mrs. Young’s notification for this evening’s meeting. The partial nomination form for the Shaker’s National District was left on his desk by Mr. Gwozdz. The form is interesting and includes some photographs from 1970 not included in the town records. It also points out a lot of the South Family dwellings located on the Cybulski property south of the Lego property.

Mr. Gwozdz stated his concern was that if there were any Shaker buildings remaining on the property, that Lego would address that. Further discussion followed.

CORRESPONDENCE

Mr. Alsbaugh stated Correspondence includes a final response from the Town Attorney’s Office regarding the Commission’s request for an opinion on 42 Frew Terrace. Mr. Alsbaugh stated it was the town attorney’s final conclusion that she agreed with the information the commission and staff had put together concerning this property and how the property was meant to be part of the District. She felt the decision was the purview of the Commission. The Commission stating that this property is part of the District is sufficient. She could see no further good being provided by her issuing a statement that she felt was better satisfied by the Commission itself.

Mr. Tatoian stated this property on Frew Terrace has been for sale and may have been sold. He noted the new owner should be advised that it is located in the Historic District.

Mr. Alsbaugh will confirm with the Town Clerk that the property is definitely part of the Historic District. Whenever any final transaction occurs on the land records, it should be treated as any other Historic District property.

Discussion Items

Mr. Alsbaugh stated Mr. Polaski has informed him that he would be ready to discuss this item at the next meeting.

ADJOURNMENT

Mr. Meyer made a motion, seconded by Ms. Smyth, to adjourn. Following a unanimous vote, the Commission adjourned at 7:30 p.m.
