ENFIELD PLANNING AND ZONING COMMISSION

REGULAR MEETING

THURSDAY, APRIL 5, 2007 – 7:30 P.M.

AQUIFER PROTECTION AGENCY AGENDA – 7:30 P.M.

1. Call to Order – Chairman Anthony DiPace called the meeting to order at 7:30 p.m.

2. Roll Call – Present were Anthony DiPace, Chairman, and Commissioners Elizabeth Ballard, Charles Duren, James Hickey, Jr., Nicles Lefakis, and Kathleen Sarno, Alternate.

3. PUBLIC HEARINGS – CONTINUED FROM MARCH 1, 2007 MEETING

a. Consideration of the adoption of Aquifer Protection Area Regulations in accordance with Connecticut General Statutes Section 22a – 3354p and R.C.S.A. Section 22a-354i-3. These regulations will enable the Agency to administer all provisions of An Act Concerning Aquifer Protection Areas, C.G.S. Section 22a-354a to Section 22a -354bb (the Act), and to approve or deny registrations, issue permits, issue permits with terms, conditions, limitations or modifications, or deny permits for all regulated activities in aquifer protection areas in the Town of Enfield pursuant to the Act. – This public hearing was continued to May 3, 2007.

4. Adjournment – Commissioner Duren made a motion, seconded by Commissioner Ballard, to adjourn. Following a unanimous vote, the Agency adjourned at 7:40 p.m.

PLANNING AND ZONING COMMISSION REGULAR MEETING – IMMEDIATELY FOLLOWING AQUIFER PROTECTIOON AGENCY MEETING

AGENDA

1. Call to Order – Chairman DiPace called the meeting to order at 7:40 p.m.

2. Roll Call - Present were Anthony DiPace, Chairman, and Commissioners Elizabeth Ballard, Charles Duren, James Hickey, Jr., Nicles Lefakis, Kathleen Sarno, Alternate, and Charles Ladd, Alternate.

3. Approval of Minutes – Commissioner Duren made a motion, seconded by Commissioner Hickey, to add approval of the Minutes of March 15, 2007 to tonight’s agenda. The motion was approved by a 7 – 0 – 0 vote.

Commissioner Hickey made a motion, seconded by Commissioner Ballard, to approve the Minutes of March 15, 2007. The Minutes were approved by a 5 – 0 – 2 vote. Commissioners DiPace and Lefakis abstained.

4. Staff Comments

a. Town Attorney – In Person

b. Zoning Enforcement Officer – In Person

c. Director of Planning

5. Public Participation - Commissioner Duren made a motion, seconded by Commissioner Lefakis, that a reasonable solution be developed within the next two weeks for the next meeting of the Commission regarding Shaker Heights or all c.o.’s from here on will be held up. The motion was approved by a 7 – 0 – 0 vote with Alternates Sarno, Ladd and Lefakis voting.

6. Correspondence – A joint meeting with the Enfield Revitalization and Strategy Committee was scheduled for Thursday, April 26, 2007 at 7:00 p.m. in the Enfield Room.

8. PUBLIC HEARINGS – Continued from March 15, 2007 Meeting:

a. PH#2593 – Change in previously approved Special Use Permit to increase the number of motor vehicles being sold or repaired on the premises to forty (40) on property located at 534 Hazard Avenue, zoned Business General (BG), Map 101, Lot 206, David R. Sarno, Applicant, Keith Prior and Martin Sullivan, Owners. (Must close by April 19.) – Chairman DiPace and Kathleen Sarno did not participate in this public hearing. This public hearing was closed.

Commissioner Duren made a motion, seconded by Commissioner Ballard, to approve PH#2593 – change in previously approved Special Use Permit to increase the number of motor vehicles being sold or repaired on the premises to forty (40) on property located at 534 Hazard Avenue with the 12 conditions as outlined in a memo from Jose Giner to the Commission dated April 5, 2007 and condition (13) that the hours of operation will be 7:00 a.m. to 9:00 p.m. Monday through Saturday and Sunday from 7:00 a.m. to 4:00 p.m. The motion was approved by a 5 – 0 – 0 vote with Alternates Sarno, Ladd and Lefakis voting.

Commissioner Duren made a motion, seconded by Commissioner Ballard, to waive the site plan requirements of Section 9.10.2 because the information is not necessary to decide on the application’s conformance with the regulations. The motion was approved by a 5 – 0 – 0 vote with Alternates Sarno, Ladd and Lefakis voting.

9. READING OF THE LEGAL NOTICE

10. PUBLIC HEARINGS - NEW

a. PH#2594 – Resubdivision for four lots (one existing frontage lot plus one proposed frontage lot and two rear lots) at 48 Steele Road, zoned R-33,Map 52, Lot 55 and Map 53, Lot 1, Tim Fortune, Applicant; Tina Smith, Owner. (Must close by May 3) – This public hearing was closed. Commissioner Duren made a motion, seconded by Commissioner Hickey, to approve PH#2594, resubdivision for four lots (one existing frontage lot plus one proposed frontage lot and two rear lots) at 48 Steele Road with the 21 conditions as outlined in a memo to the Planning and Zoning commission from Jose Giner dated April 5, 2007. The motion was approved by a 7 – 0 – 0 vote with Alternates Sarno, Ladd and Lefakis voting.

b. PH#2595 – Special Use Permit for Rear Lot (#3) on resubdivision application PH#2594 on property located south of 48 Steele Road, zoned R-33, Map 52, Lot 55, Tim Fortune, Applicant; Tina Smith, Owner. (Must close by May 3) – This public hearing was closed. Commissioner Duren made a motion, seconded by Commissioner Hickey, to approve PH#2595 – Special Use Permit for rear lot (#3) on resubdivision application PH#2594 on property located south of 48 Steele Road, zoned R-33 subject to the 20 conditions as outlined in a memo from Jose Giner to the Planning and Zoning Commission dated April 5, 2007. The motion was approved by a 7 – 0 – 0 vote with Alternates Sarno, Ladd and Lefakis voting.

c. PH#2596 – Special Use Permit for Rear Lot (#4) on resubdivision application PH#2594 on property located south of 48 Steele Road, zoned R-33, Map 52, Lot 55, Tim Fortune, Applicant; Tina Smith, Owner. (Must close by May 3). – This public hearing was closed. Commissioner Duren made a motion, seconded by Commissioner Hickey, to approve PH#2596, Special Use Permit for Rear Lot (#4) on resubdivision application PH#2594 on property located south of 48 Steele Road, zoned R-33 subject to the 20 conditions as outlined in a memo from Jose Giner to the Planning and Zoning Commission dated April 5, 2007. The motion was approved by a 7 – 0 – 0 vote with Alternates Sarno, Ladd and Lefakis voting.

d. PH#2597 – Resubdivision to separate 3.2201 acres from property located at 96 Steele Road, zoned R-44, Map 52, Lot 1, Michael Nelson, Applicant; Mary Joan Flaherty, Owner. (Must close by May 3) – This public hearing was closed. Commissioner Duren made a motion, seconded by Commissioner Hickey, to approve PH#2597 – resubdivision to separate 3.2201 acres from property located at 96 Steele Road, zoned R-44 subject to the 20 conditions as stated in a memo from Jose Giner to the Commission dated April 5, 2007 and Condition (21) The fee in lieu of open space shall be submitted at a later date and be acceptable to the Commission.

Commissioner Duren made a motion, seconded by Commissioner Hickey, to waive the sidewalks for PH#2597. The motion was approved by a 7 – 0 – 0 vote with Alternates Sarno, Ladd and Lefakis voting.

The main motion was approved by a 7 – 0 – 0 vote with Alternates Sarno, Ladd and Lefakis voting.

e. PH#2599 – Special Use Permit for change of nonconforming use from convenience store/deli to deli/take-out pizza shop at the Riverview Shops, 165 Elm Street, zoned R-33, Map 57, Lot 200, Athanasios Koukopoulos, Applicant; Riverview Shops LLC, Owner. (Must close by May 3). – Commissioner Duren made a motion, seconded by Commissioner Lefakis, to approve a Special Use Permit for a change of a nonconforming use from a convenience store/deli to deli/take-out pizza shop at the Riverview Shops, 165 Elm Street, zoned R-33 with the 9 conditions as outlined in a memo from Jose Giner to the Commission dated April 5, 2007 and Condition (10) The hours of operation are 10:00 a.m. to 9:00 p.m. Monday through Sunday. The motion was approved by a 7 – 0 – 0 vote with Alternates Sarno, Ladd and Lefakis voting.

11. Old Business

a. Bond Releases

1. PH#2323 – Request for release of Landscape Bond in the amount of $4,200 for Street Trees for 7 Frontage Lots for Shaker Heights Subdivision – Taylor Road. – This bond release was tabled.

12. New Business

a. SPR#1393 – Application for soft serve ice cream shop with slide window service at 46 High Street, zoned TVCD, Map 24, Lot 103, Sean Gondarowski, Applicant/Jeff and Angela Foss, Owners. – This application was continued to the next meeting.

13. Other Business

1. Informal Discussion with Attorney Greg Galanek re: 167 South Road.

2. Discussion on a six-month moratorium for Senior Planned Residential Developments.

3. New applications to be received/Set public hearing dates – The following applications were received by the Commission:

PH#2600 – Petition to consent for zone change at 127 Pearl Street, zoned R-33 to TV at 127 Pearl Street, Richard Binns, Applicant/Masonic Building Association, Owner.

A public hearing will be held on May 3, 2007.

PH#2601 – Application for amendment to zoning map/petition to amend zoning map 101, Lot 1, from I-1 to R-33 located at southwest corner of the intersection of North Street and Taylor Road (Assessor’s Map 101, Parcel 1), Pace Construction, Applicant.

A public hearing will be held on May 17, 2007.

PH#2602 – Application for Special Use Permit to operate a small artist studio that will replace the existing permitted pet grooming shop at 390 Hazard Avenue, zoned HV33, Map 92, Lot 175, Danielle M. Chesley, Applicant/Lorina Buonanducci, Owner.

A public hearing will be held on May 3, 2007.

SPR#1394 – Request for administrative approval of Coleman Brothers Carnival (Held yearly) at the Enfield Square for May 2 through May 6.

The Commission directed Mr. Giner to handle this administratively.

SPR#1395 – Application for installation of awnings on front of building at 150 Enfield Street, zoned BL, Map 34, Lot 163, Paul Oliver (Taylor Rental), Applicant/Owner.

The Commission directed Mr. Giner to handle this administratively.

4. Discussion of Regulations.

14. Adjournment – Commissioner Hickey made a motion, seconded by Commissioner Sarno, to adjourn. Following a 7 – 0 – 0 vote, the Commission adjourned at 12:00 midnight.
