Call to Order & Pledge of Allegiance - Chairman James Howard called the meeting to order at 7:30 p.m. 2. Roll Call - Chairman James Howard and Commissioners Anthony DiPace, Charles Duren, Robert Egan, James Hickey, Jr., Karen Krebs, Nicles Lefakis, and Karen Weseliza, Alternate were present. 3. Approval of Minutes - September 19, 2002 - Commissioner Duren made a motion, seconded by Commissioner Krebs, to approve the Minutes of September 19, 2002. Correspondence 7. Commissioner's Correspondence 8. PUBLIC HEARINGS - Continued from September 19, 2002 meeting a. PH #2332 - Application for a Special Use Permit for Class 1 permit for beer and wine at a restaurant (El Sarape) at 917 Enfield Street, Zoned BL, Map 26, Lot 78, Eduardo A. Chavez, applicant, Julie Lai, owner (Must close tonight) - This public hearing was closed. Commissioner Duren made a motion, seconded by Commissioner DiPace, to approve PH#2332. The motion was denied without prejudice by a 0 - 7 - 0 vote.
b. PH #2331 - Application for a Special Use Permit for modification of plans previously approved to allow construction of a 7,234 S.F. addition to the existing car dealership building at 20 Palomba Drive, Zoned BR, Map 57, Lot 335, LIA Auto Group, applicant/owner. (Must Close by October 17) - This public hearing was continued to the October 17 meeting.
c. PH #2333 - Application for a Special Use Permit for change of a nonconforming automotive repair use at 66 Fletcher Road, Zoned R-88, Map 118, Lot 3, Steven P. Jacques, applicant/owner. (Must Close by October 17) - This pubic hearing was closed. Commissioner Weseliza made a motion, seconded by Commissioner Krebs to approve PH#2333. The motion was denied by a 0 - 7 - 0 vote. Chairman Howard recommended that Mr. Jacques meet with the Director of Planning regarding this use. Commissioner Weseliza made a motion, seconded by Commissioner Hickey, for a recess. The motion was approved by a unanimous vote and the Commission recessed at 9:35 p.m. The Commission reconvened at 9:55 p.m. READING OF THE LEGAL NOTICE 9. PUBLIC HEARINGS - NEW a. PH #2334 - Application for a Special Use Permit to operate a driving school at 139 Hazard Avenue, Unit 11, Zoned BP, Map 65, Lot #76, Philip J. Michaud, owner/applicant. (Must close by November 7) - This public hearing was closed. Commissioner Duren made a motion, seconded by Commissioner Lefakis, to approve PH#2334 with the following conditions:
Conditions to be met prior to the issuance of permits:
1. The conditions of this approval shall be binding on the applicant, land owners, and their successors and assigns.
2. This approval will become effective upon the filing of a Special Use Zoning Certificate signed by the Commission Secretary on the Land Records by the owner of the property. Proof of such filing shall be in the file prior to the issuance of any permits.
General Conditions:
3. This approval is for the specific use and structure identified in the application. Any change in the nature of the use or the structure will require new approvals from the Enfield Planning and Zoning Commission.
The motion was approved by a 7 - 0 - 0 vote.
b. PH #2336 - Application for a Modification to PH #2235 to add an additional 34 parking spaces to the west side of Prudence Crandall School at 150 Brainard Road, Zoned R-33, Map 62, Lot 65, Town of Enfield owner/applicant. (Must close by November 7). This public hearing was closed. Commissioner DiPace made a motion, seconded by Commissioner Krebs, to approve PH#2336 with the following conditions: 1. All plans submitted shall require the seal and live signature of the appropriate professional(s) responsible for the preparation of the plans.
2. The conditions of this approval shall be binding on the applicant, land owners, and their successors and assigns.
Conditions to be met prior to the issuance of permits:
3. One set of mylars and two sets of paper plans, with any required revisions incorporated on the sheets, shall be submitted to the Planning and Community Development Department for signature of the Commission.
4. This approval will become effective upon the filing of a Special Use Zoning Certificate signed by the Commission Secretary on the Land Records by the owner of the property. Proof of such filing shall be in the file prior to the issuance of any permits.
Conditions which must be met prior to the issuance of a Certificate of Compliance:
5. Complete as-built plans certified to Class A-2 accuracy shall be submitted prior to the issuance of any certificates of zoning compliance.
6. In accordance with Section 16-8.6, the applicant shall also submit to the Planning Director final plans as approved by the Commission in a digital format prescribed by the Director.
General Conditions:
7. This approval is for the specific use and structure identified in the application. Any change in the nature of the use or the structure will require new approvals from the Enfield Planning and Zoning Commission.
8. This project shall be constructed and maintained in accordance with the referenced plans. Minor modifications to the approved plans may be allowed in accordance with the regulations, subject to staff review and approval.
9. All snow plowing shall be done to the front of the parking lot and not toward the abutting residential homes.
The motion was approved by a 7 - 0 - 0 vote.
c. PH #2338 - Application for a Modification to PH #2225 to add an additional driveway access to a parking area located at the east end of the parking lot adjacent to Parkman School on Weymouth Road, Zoned R-33, Ma 52, Lot 60, Town of Enfield owner/applicant. (Must close by November 7) - This public hearing was closed. Commissioner DiPace made a motion, seconded by Commissioner Krebs, to approve PH#2338 with the condition that a one-way sign be installed. All other conditions that were part of the original site plan approval stay in full force and effect. The motion was approved by a 7 - 0 - 0 vote. c. PH #2340 - Application for a Special Use Permit to allow for electronic amusement (cybernet games) at a unit of the Westfield Shoppingtown located at 90 Elm Street, Zoned BR, Map 43, Lot 17, Irfan Raheez, applicant; Westfield Shoppingtown, owner. (Must closed by November 7). This public hearing was closed. Commissioner Duren made a motion, seconded by Commissioner DiPace, to approve PH#2340 with 16 units and the following conditions: 1. The operating hours shall be the same as those of the Westfield Shoppingtown Mall. 2. The conditions of this approval shall be binding on the applicant, land owners, and their successors and assigns.
3. This approval will become effective upon the filing of a Special Use Zoning Certificate signed by the Commission Secretary on the Land Records by the owner of the property. Proof of such filing shall be in the file prior to the issuance of any permits.

e. PH #2341 - Application for a Special Use Permit to allow an accessory coffee shop in an existing bicycle shop at 270 Enfield Street, Zoned BL, Map 34, Lot 161, State Line Cycles, owner/applicant. (Must close by November 7) - This public hearing was continued. The Commission requested that the Director of Planning check to see what the Town's jurisdiction is in the area of color for this building. f. PH #2342 - Application for a re-subdivision and site plan review to reconfigure existing lot lines and construct additional parking for an existing industrial building located at 3 Anginna Drive, Zoned I-1, Map 82, Lots 26 and 27. (Must close by November 7) - Commissioner DiPace made a motion, seconded by Commissioner Duren, to accept the withdrawal of PH#2342 without prejudice. The motion was approved by a 7 - 0 - 0 vote. 10. Old Business a. PH #2320 - Application for a rear lot (Lot#11) in a proposed open space subdivision on property off Bridge Lane and Riverview St. (Meetinghouse Lane), Zoned R-33, Map 19, Lot 10, Margaret R. Pappas/Hampden & Beech Inc. applicant/Margaret Pappas, owner. (Decision by November 7) - Commissioner DiPace made a motion, seconded by Commissioner Krebs, to approve PH#2320 with the standard conditions for special permits and subdivisions. The motion was denied by a 0 - 7 - 0 vote with Alternate Karen Weseliza voting. Commissioner Lefakis did not participate in this application. b. PH #2321 - Application for a rear lot (Lot #24) in a proposed open space subdivision on property off Bridge Lane and Riverview St. (Meetinghouse Lane), Zoned R-33, Map 19, Lot 10, Margaret R. Pappas/Hampden & Beech Inc. applicant/Margaret Pappas, owner. (Decision by November 7) - Commissioner DiPace made a motion, seconded by Commissioner Krebs, to approve PH#2321 with the standard conditions for special permits and subdivisions. The motion was denied by a 0 - 7 - 0 vote with Alternate Karen Weseliza voting. Commissioner Lefakis did not participate in this application. c. PH #2319 - Application for a Special Use Permit for 24 lot open space subdivision on property off Bridge Lane and Riverview St. (Meetinghouse Lane), Zoned R-33, Map 19, Lot 10, Margaret R. Pappas/Hampden & Beech Inc. applicant/Margaret Pappas, owner. (Decision by November 7) - Commissioner DiPace made a motion, seconded by Commissioner Krebs, to approve PH#2319 with the standard conditions for special permits and subdivisions. The motion was denied by a 0 - 7 - 0 vote with Alternate Karen Weseliza voting. Commissioner Lefakis did not participate in this application. d. PH #2318 - Application for a 24 lot resubdivision on property off Bridge Lane and Riverview St. (Meetinghouse Lane), Zoned R-33, Map 19, Lot 10, Margaret R. Pappas/Hampden & Beech Inc. applicant/Margaret Pappas, owner. (Decision by November 7) - Commissioner Duren made a motion, seconded by Commissioner Krebs, to approve PH#2318 subject to the standard conditions for special permits and subdivisions. The motion was denied by a 0 - 7 - 0 vote with Alternate Karen Weseliza voting. Commissioner Lefakis did not participate in this application. e. Bond Releases 1. PH #2086 - Application for release of $6,930 Engineering Bond for ATM Kiosk at Stateline Plaza, 130 Elm Street. - Commissioner DiPace made a motion, seconded by Commissioner Krebs, to approve the bond release in the amount of $6,930 for the ATM Kiosk at Stateline Plaza, 130 Elm Street. The motion was approved by a 7 - 0 - 0 vote. 11. New Business a. SPR #1189 - Application for a Site Plan review to locate telecommunication antennas on an existing water tank, with related ground facilities, located at 290 Brainard Road, Zoned R-44, Map 77, Lot 65, AT&T Wireless PCS, LLC. Applicant/ CT Water Company, owner. (Decision by November 7) - Commissioner DiPace made a motion, seconded by Commissioner Krebs, to approve SPR#1189 with the standard conditions for site plan approval. The motion was approved by a 7 - 0 - 0 vote. 12. Receipt of Applications The following applications were accepted by the Commission: PH #2346 - Application for putting on a sun room on an existing deck at 2 Woodbridge Drive, Siding & Windows of CT, applicant. - A public hearing will be scheduled for October 17, 2002. PH #2347/SPR #1196 - Application to construct a bank, with a drive through facility and signing at 73 Hazard Avenue, Zoned BL, Map 56, Lot 6, Tolland Bank, applicant / Joseph J. Seremet, Jr., owner. - A public hearing will be scheduled for November 1, 2002. SPR #1190 - Application to operate a limited access pharmacy for custodial, assisted living and long-term care patients. We will have very few walk-in clients at 7 Anngina Drive, Zoned I-1, Map 82, Lot 56, Drug-Assist Health Solutions, applicant/owner. PH#1195 - Application for modification of plan previously approved for construction of Veterans World War II Monument on the Town Green at 820 Enfield Street, Zoned TVCZ, Map 26, Lot 15, Town of Enfield, applicant/owner. - A public hearing will be scheduled for October 17, 2002. SPR #1196 - See Above PH #2347 SPR #1197 - Application for change of use - office at 178 North Maple Street, Zoned I-1, Map 81, Lot 109, The Slanetz Family Trust, applicant/owner. SPR #1198 - Application to add gable and replace existing cupola and roof on bank building at 800 Enfield Street, Zoned BG, Map 29, Lot 2, Edward Polchlopek, Jr., applicant / Sovereign Bank, owner. 13.
