MINUTES OF A REGULAR MEETING
MARCH 1, 2007
A Regular Meeting of the Enfield Aquifer Protection Agency was held on Thursday, March 1, 2007 in the Council Chambers, Enfield Town Hall, 820 Enfield Street, Enfield, Connecticut. Chairman DiPace called the meeting to order at 7:30 p.m.

AQUIFER PROTECTION AGENCY AGENDA – 7:30 P.M.
Chairman Anthony DiPace call the Aquifer Protection Agency to order at 7:30 p.m. Present were Chairman Anthony DiPace and Commissioners Jeffrey Cooper, Charles Duren, James Hickey, Jr., Jason Jones, Karen Weseliza, Kathleen Sarno, Alternate, and Charles Ladd, Alternate.
PUBLIC HEARINGS – CONTINUED FROM JANUARY 18, 2007 MEETING
a. Consideration of the adoption of Aquifer Protection Area Regulations in accordance with Connecticut General Statutes Section 22a-354p and R. C. S. A. Section 22a-354i-3. These regulations will enable the Agency to administer all provisions of An Act Concerning Aquifer Protection Areas, C.G.S. Section 22a-354a to Section 22a-354bb (the Act), and to approve or deny registrations, issue permits, issue permits with terms, conditions, limitations or modifications, or deny permits for all regulated activities in aquifer protection areas in the Town of Enfield pursuant to the Act.
Chairman DiPace noted earlier this evening a workshop was held on aquifer protection because there were a lot of items still outstanding and questions and concerns that needed to be addressed. Chairman DiPace stated an additional workshop will be scheduled in the near future. He noted even if the Aquifer Protection Area Regulations get adopted by this summer, implementation would be late fall or early winter.
Mr. Giner stated after the Commission adopts the regulations, they have to go to the Commissioner and there is a certain amount of time for them to be returned to the town.
It becomes effective after they review and approve it and the first round of registrations would be within three months.
Commissioner Duren asked if the questions the Commission had initially have ever been answered. Mr. Giner stated Steve has been talking to the DEP about some of those issues. Commissioner Duren would like to see the responses to the Commission’s questions in writing.
Mr. Giner noted there was some new material tonight. One of the items that surfaced from the previous hearings was to try to do something to alleviate the costs for existing businesses. He did propose a new Section g. that would waive the registration fee for first time registrations received within 180 days. If businesses comply with the requirements to register within the time frames the law says they have to, then all fees would be waived. This would be both for existing Level A areas and also for any new mapping areas.
Chairman DiPace stated who will be doing the enforcement was also discussed and the Commission is working on this. Depending upon how it is done, there may be very little cost to the town. Commissioner Sarno asked who inspects it for other towns. Chairman DiPace stated it is sometimes the water companies or the fire departments.
Chairman DiPace recommended continuing this hearing until the outstanding items are resolved.
Commissioner Weseliza asked if whoever has the oversight would get the applications initially. Mr. Giner stated this Commission and the Planning Office would still be the agency to receive the applications. The discussion is involving inspections and that is something that will be looked into.
Chairman DiPace opened this hearing to the audience. No one spoke in favor or against this public hearing.
Chairman DiPace continued this public hearing to April 5, 2007.
ADJOURNMENT
Commissioner Jones made a motion, seconded by Commissioner Duren, to adjourn. Following a unanimous vote, the Aquifer Protection Agency adjourned at 7:38 p.m.
