INVITATION TO BID

The Town of Enfield is accepting sealed bids for:

PURCHASE OF MUNICIPAL TAX LIENS

The property locations of the liens being sold are identified as follows

  • 249 Shaker Road
  • Ashmead Commons Unit #’s 207, 208, 503,504
  • 442 Enfield Street
  • 76 Pearl Street
  • 22 Broad Brook Road
  • Bids shall be submitted in the manner specified. Requirements and specifications may be obtained from the Department of Finance. Sealed bids will be accepted at the Department of Finance, until 11:00 A.M. local time on Wednesday, June 23, 1999 at which time they will be publicly opened and read.

    Each bid shall be accompanied by a Certified Check in the amount of ten- (10)% of the bid amount in Dollars, refundable to unsuccessful bidders.

    The Town is requesting written sealed bids from prospective purchasers for the purchase of part of the Town's delinquent municipal tax liens pursuant to the current provisions of Connecticut General Statutes §12-195h and in accordance with the terms of this Invitation to Bid.

    Those firms or individuals that believe they are qualified are encouraged to submit a bid, together with general information and in accordance with the specific information requested.

    The right is reserved by the Town of Enfield to reject any or all bids, in whole or in part, to award any part or parts, or total bid, and to waive informality or technical defects, if it is deemed to be in the best interest of the Town of Enfield.

    STANDARD TERMS AND CONDITIONS

     

     

    BID SUBMISSION INSTRUCTIONS:

    Bids are to be submitted in a sealed envelope. The sealed envelope must have the Bidder's name and address in the upper left-hand corner and the words "BID DOCUMENT for: Purchase of Municipal Tax Liens to be opened on Wednesday, June 23, 1999 at 11:00 A.M." in the lower left-hand corner.

    Bids must be completed, submitted and signed in the full legal name of Bidder, and must be fully and properly executed by an authorized person.

    Bids received after the time and date specified shall not be considered and shall be returned unopened.

    Amendments to or withdrawal of bids received later than the time and date set for the bid opening will not be considered.

    Bidders or their representatives may be present at the bid opening.

    BID SURETY:

    Each bid shall be accompanied by a Certified Check in the amount of ten- (10)% of the bid amount in Dollars.

    The successful Bidder's surety will be applied to the purchase price.

    LIQUIDATED DAMAGES:

    The successful Bidder, upon their failure or refusal to close when requested, shall forfeit to the Town, as liquidated damages for such failure or refusal, an amount equal to the surety deposited with their bid. Such forfeiture shall not be considered a penalty, but as liquidated damages to compensate the Town for the loss or deprivation of the sale.

    AWARD:

    The Director of Finance reserves the right to make an award on the bid which, by the Director’s judgment best meets the specifications and is deemed to be in the best interest of the Town of' Enfield.

    The Director of Finance further reserves the right to reject any or all bids, in whole or in part, to award any part or parts, or total bid, and to waive informality or technical defects, if, in his judgment, the best interests of the Town of Enfield will so be served.

    No award will be made to any corporation, firm or individual who is in arrears to the Town by debt or contract, or who is in default as security or otherwise by any obligation to the Town of Enfield, Connecticut.

    The Town may reject, at its sole discretion, any bid that is less than the full amount (principal, interest and lien fees) of the lien or liens being offered for sale if the bidder (1) is the owner of the property subject to the lien or liens, (2) is a relative of the owner of the subject property, (3) is a subsidiary of the owner of the subject property, or (4) is an agent or attorney for the owner of the subject property.

    All bidders must submit with their bids a notarized Affidavit stating that the bidder (1) is not the owner of the subject property, (2) is not a relative of the owner of the subject property, (3) is not a subsidiary of the owner of the subject property, and (4) is not an agent or attorney for the owner of the subject property. If the bidder has an interest in the subject property the Affidavit shall specify bidder’s interest therein. If the bidder is a relative of, subsidiary of, agent or attorney for the owner of the subject property, the affidavit shall identify the party and the party’s interest in the subject property and shall specify the bidder’s relationship to that party.

    The Town, at its sole discretion, may void the sale of any lien or liens if it is discovered, after the sale of the lien or liens for less than the full amount, that the successful bidder’s Affidavit contains misrepresentations as to the identity of the bidder, the bidder’s interest in the property or the bidder’s relationship to the owner of the property. In the event that a sale is voided, the bidder shall immediately return the liens to the Town, execute any documents deemed necessary to evidence the return of the liens, and shall terminate any foreclosure proceedings brought thereon. Any amounts paid by the bidder shall be retained by the Town and applied to the outstanding taxes, interest and lien fees on the subject property. However, the Town may not void any sale after a Judgement of Foreclosure on the tax liens has been entered by the Superior Court of the State of Connecticut and the subject property has been sold to a bona fide purchaser, unrelated to the bidder or the owner of the property.

    INSTRUCTIONS TO BIDDERS

    Receipt and Opening of Bid:

    The Town of Enfield, Connecticut, (herein called the "Town"), invites bids on the forms
    attached hereto, all blanks of which shall be appropriately filled in. Separate, sealed bids will be received by the Director of Finance, or authorized Representative, in the Council Chambers, Town Hall, Enfield, Connecticut 06082-2997 until the time and date stated in the Invitation To Bid. Bids shall then be publicly opened and read aloud.

    All bids shall be submitted in sealed envelopes clearly labeled with the Bidder's
    name, address, and the words "Bid Document" must appear on the envelope with the time and date to be opened. If mailed, the sealed, envelope containing the bid, marked as described above, shall be enclosed in another envelope properly addressed for mailing. No responsibility will be attached to any Town Representative or employee for the premature opening of a bid not properly addressed and identified.

    2) Preparation of the Bid: Each bid shall be submitted on the bid form annexed hereto. Bids shall be signed by the Bidder and all blank spaces shall be filled in, in ink or typewritten, both in words and figures. No change shall be made in the phraseology of the bid or in the items mentioned therein. All bids shall be prepared in conformity with and shall be based upon and submitted subject to all requirements of the specifications together with all addendum (or addenda) thereof.

    Method of Bid: The Town may make such investigations as it deems necessary to determine the ability of the Bidder to perform the service, and the Bidder shall furnish to the Town all such information and data for this purpose as the Town may request. The Town reserves the right to reject any bid if the evidence submitted by, or investigation of such Bidder fails to satisfy the Town that such Bidder is properly qualified to carry out the obligations. Conditional bids will not be accepted.

    Addenda and Interpretations: No interpretation of the meaning of the plans, specifications or other Contract Documents will be made to any Bidder orally. Every request for such interpretation should be in writing, addressed t

    And to be given consideration, must be received at lease five (5) days prior to the date fixed for the opening of bids. Any and all such interpretations and any supplementary instructions will be in the form of written addenda to the specifications which, if issued, will be mailed by Certified Mail to all prospective Bidders at the respective address furnished for such purpose, not later than three (3) days prior to the date fixed for the opening of bids. Failure of any Bidder to receive such addenda or interpretation shall not relieve any Bidder from any obligations under his/her bids as submitted.

    Subcontractors: The Bidder is specifically advised that any person, firm or other party to whom it is proposed to award a subcontract under this contract must be acceptable to the Town and that approval of the proposed subcontract award cannot be given by the Town unless and until the successful Bidder submits all information and evidence to the Town regarding the proposed subcontractor requested by the Town. Although the Bidder is not required to attach such information and evidence to the bid, the Bidder is hereby advised of this requirement so that appropriate action can be taken to prevent subsequent delay in subcontract awards.

     

    Withdrawal of Bids: Bids may be withdrawn personally or on written or fax or telegraphic request dispatched by the Bidder in time for delivery in the normal course of business prior to the time fixed for opening, provided that written confirmation is placed in the mail and postmarked prior to the time set for bid opening. Negligence on the part of the Bidder in preparing the bid confers no right of withdrawal or modification of the bid after such bid has been opened. The fax number is (860) 253-6331.

    7)  Special Considerations:

    The Town reserves the right to reject any or all bids and may waive any informalities.

    The Town reserves the right to correct any award erroneously made as a result of a clerical error.

    Corrections: Erasures or other changes in the bid shall be explained or noted over the signature of the Bidder.

    Obligation of Bidder:

    (a) At the time of the opening of bids, each Bidder will be presumed to have read and to be thoroughly familiar with the specifications and other Contract Documents (including all addendum or addenda). The failure or omission of any Bidder to receive or examine any form, instrument or document which has been sent to the address given such Bidder, or the failure of the Bidders to familiarize themselves with the conditions relating to the specifications shall in no way relieve any Bidder from any obligation in respect to the bid.

    (b) The Bidder is responsible for submitting a bid that will conform to all existing Federal, State of Connecticut, and Town of Enfield statutes, ordinances, and regulations. Attention is called specifically to the State requirement relative to licensing of corporations and registrations of partnerships and fictitious names.

    Patents: The Bidder shall hold and save the Town and its officers, agents, servants, and employees harmless from liability of any nature or kind, including cost and expenses for, or on account of, any patented or unpatented invention, process, article, or appliance manufactured or used in the performance of the contract, including its use by the Town, unless otherwise specifically stipulated in the bid documents.

    Past Debts: A Contract will not be awarded to any corporation, firm, or individual who is in arrears to the Town by debt or contract, or who is in default as security or otherwise by any obligation to the Town.

    Right to Reject Bid: The Town of Enfield reserves the right to reject any and all bids or quotations, to waive any discrepancies in the bids, quotations, or specifications, when deemed to be in the best interest of the Town and also to award any part, all or none of the service(s) specified.

    Non-Collusive Bid Statement: All Bidders shall be required to provide a signed non-collusive statement with all the public bids as follows:

    The bid has been arrived at by the Bidder independently and has been submitted without collusion with, and without any agreement, understanding, or planned common course of action with, any other Bidder for the purchase of the liens described in the Invitation to Bid, designed to limit independent bidding or competition, and;

    The contents of the bid have not been communicated by the Bidder or his/her employees or agents to any person not an employee or agent of the Bidder or its surety on any bond furnished with the bid, and will not be communicated to any such person prior to the official opening of the bid.

    Code of Ethics: Bidders are specifically advised that the Town of Enfield adopted a Code of Ethics, effective 10/22/96, located in Article II of the Enfield Town Code and available at the Town Clerk's office. Bidders are encouraged to review same.

    Indemnify and Hold Harmless: Bidder does hereby defend and indemnify the Town of Enfield, its employees, officials, successors and assigns and agree to hold it/them harmless by reason of any and all loss, cost or damage, including attorneys’ fees and court costs, which the Town of Enfield may sustain by reason of the purchase of liens or the condition of the property securing the liens.

    No Representations Made: The Town of Enfield makes no representations as to the condition, value or marketability of the real property which is subject to the liens described in the Invitation to Bid. The town of Enfield makes no representations as to the said real property’s compliance with Federal, State or Local laws or regulations. The Town of Enfield is not conveying real property. The Town of Enfield is assigning municipal tax liens pursuant to Conn. Gen. Stat. §12-195h. The liens are conveyed "AS IS" with no representations made as to their validity.

    Purchase of Future Liens: The successful Bidder shall purchase all future liens against the liened property until title to such property vests in party other than the present owner.
